Course Overview

Legal departments handle some of the most sensitive information in any organisation, and AI tools can assist with research, document drafting, and case management, but only if confidentiality and privacy are safeguarded. 

This course shows lawyers and legal professionals how to navigate the risks posed by AI under the AI Act and GDPR. 

You’ll examine mistakes that can lead to breaches of privilege and ethics violations. In one example, an in-house counsel uses an external AI chatbot to draft a disciplinary letter, entering the employee’s name, address, and allegations without removing identifying details. Another scenario involves uploading detailed witness statements to an AI summarisation service without anonymisation or a data processing agreement. A third explores how feeding confidential case strategies and client information into an external research tool jeopardises client confidentiality. These cases illustrate how easily privileged information can leak when AI is misused.

Building on them, the course offers clear instructions for responsible practice: never input sensitive personal data or confidential case details into external AI tools; anonymise or generalise information when using AI for drafting or research; conduct privacy and confidentiality impact assessments before adopting new tools; and verify third-party providers’ security practices through formal agreements. 

We also explain how the AI Act’s transparency and human oversight requirements intersect with GDPR obligations and professional codes of conduct.
