Executive Summary
Article 4 of the EU AI Act (Regulation (EU) 2024/1689) imposes a single, deceptively simple obligation: providers and deployers of AI systems must take measures to ensure, to their best extent, a sufficient level of AI literacy among their staff and other persons dealing with the operation and use of AI systems on their behalf.
This provision entered into force on August 2, 2025 โ alongside the transparency obligations for limited-risk AI and the rules on general-purpose AI models. It is not subject to a grace period. It is not limited to high-risk AI systems. It applies across every risk category, including minimal-risk AI that otherwise carries no specific obligations under the Act.
And most organisations are not ready.
A 2024 survey by the European Commission's AI Office found that fewer than 25% of organisations using AI in the EU had a formal AI literacy or AI training programme in place. Meanwhile, AI adoption is accelerating: Eurostat's ICT Usage Survey 2024 reported that 13.5% of EU enterprises used AI technologies โ up from 8% in 2023. McKinsey's State of AI survey (2024) found that 72% of organisations globally now deploy AI in at least one business function, up from 55% the previous year.
The gap between AI adoption and AI understanding is a compliance risk. Article 4 is designed to close it.

What Does Article 4 Actually Say?
The full text of Article 4 is brief. In its entirety:
"Providers and deployers of AI systems shall take measures to ensure, to their best extent, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf, taking into account their technical knowledge, experience, education and training and the context the AI systems are to be used in, and considering the persons or groups of persons on whom the AI systems are to be used."

Despite its brevity, this single article creates a horizontal obligation that cuts across every other provision of the AI Act. Let us parse the key elements.
"Providers and deployers"
This covers the two primary roles defined by the AI Act. Providers (Article 3(3)) are entities that develop or place AI systems on the market. Deployers (Article 3(4)) are entities that use AI systems under their authority. This means both the company that builds the AI tool and the company that uses it must ensure AI literacy โ the obligation is not delegable from one to the other.
"To their best extent"
This is a proportionality qualifier. The obligation is not absolute โ organisations are expected to take reasonable measures given their size, resources, and context. However, "best extent" is not a free pass. It requires demonstrable effort, not merely a statement of intent. Supervisory authorities will evaluate whether the measures taken were proportionate and genuine.
"Sufficient level of AI literacy"
The Act does not prescribe specific curricula, certifications, or training hours. Instead, it uses a principles-based standard: the literacy must be "sufficient" given the context. Recital 20 of the Regulation provides guidance on what this means:
"AI literacy refers to skills, knowledge and understanding that allow providers, deployers and affected persons, taking into account their respective rights and obligations in the context of this Regulation, to make an informed deployment of AI systems and to gain awareness about the opportunities and risks of AI and possible harm it can cause."

"Staff and other persons dealing with the operation and use"
The scope extends beyond direct employees. It includes contractors, consultants, outsourced teams, and any other persons operating or using AI systems on the organisation's behalf. This is critical for organisations that rely on third-party service providers for AI operations.
"Taking into account their technical knowledge, experience, education and training"
This requires a differentiated approach. A data scientist and a customer service representative using an AI chatbot do not need the same level of literacy. The organisation must tailor its programme to the role, background, and responsibilities of each person.

This requires the programme to address the specific use case and the affected population. An AI system used for credit scoring requires literacy about financial inclusion risks and algorithmic bias. An AI system used for employee scheduling requires literacy about labour rights and fairness.
Why AI Literacy Is the Most Overlooked Obligation in the AI Act
The EU AI Act's implementation timeline has driven organisations to focus on the highest-stakes obligations first: prohibited AI practices (effective February 2, 2025), high-risk AI requirements (effective August 2, 2026), and general-purpose AI model rules. Article 4, by contrast, looks simple โ "train your staff" โ and has received comparatively little attention.
This is a strategic mistake for several reasons.
1. Article 4 Has the Earliest Effective Date for Positive Obligations
Prohibited AI bans required organisations to stop doing certain things. Article 4 is the first provision that requires organisations to actively do something โ build competence and provide training. Its effective date of August 2, 2025 means it is already enforceable.
2. It Applies to ALL AI Systems, Not Just High-Risk
Unlike most AI Act obligations, Article 4 is not limited to high-risk AI systems. Even if your organisation only uses minimal-risk AI โ chatbots, content generators, translation tools, scheduling assistants โ Article 4 still applies. This means every organisation using AI in the EU has at least one mandatory AI Act obligation, regardless of risk classification.
3. It Is a Precondition for Meaningful Compliance With Everything Else
Human oversight (Article 14), risk management (Article 9), incident reporting (Article 62), and transparency (Articles 50, 52) all depend on the people involved understanding what AI systems do and how they work. Without AI literacy, these obligations cannot be meaningfully fulfilled.
4. Regulators Will Use It as a Leading Indicator
When supervisory authorities begin enforcement, AI literacy programmes โ or the lack thereof โ will be among the first things they examine. A well-documented AI literacy programme demonstrates organisational commitment to AI governance. Its absence signals systemic non-compliance.
The Enforcement Gap
The European Commission's AI Office has published guidance noting that national competent authorities are expected to take AI literacy obligations into account during supervisory activities from August 2025 onwards. While large-scale enforcement actions specifically targeting Article 4 have not yet occurred as of March 2026, several national authorities โ including Germany's BNetzA and France's CNIL (acting in an advisory capacity on AI) โ have signalled that AI literacy will be assessed as part of broader AI Act compliance reviews.
The penalty for non-compliance with Article 4 falls under the general infringement tier: up to EUR 7.5 million or 1.5% of global annual turnover, whichever is higher (Art. 99(4)).

Key Implications by Organisation Type
Large enterprises using AI extensively must build comprehensive, role-differentiated AI literacy programmes covering all departments and functions where AI is deployed.
SMEs have proportionality protection ("to their best extent"), but are not exempt. An SME using AI-powered accounting software, CRM tools, or customer service chatbots must ensure relevant staff understand how those tools work, what their limitations are, and what risks they carry.
Public sector bodies deploying AI (e.g. for benefits administration, fraud detection, or citizen services) have heightened obligations given the impact on fundamental rights. Recital 20 specifically notes that AI literacy should account for the persons on whom AI is used โ in public services, this means vulnerable populations.
Non-EU organisations are in scope if they place AI on the EU market or if their AI output is used in the EU (Art. 2(1)). A US SaaS company providing AI-powered analytics to EU customers is a provider under the Act and must ensure its own staff have sufficient AI literacy.
Who Specifically Needs AI Literacy Within an Organisation?
Article 4 refers to "staff and other persons dealing with the operation and use of AI systems." This means:

What AI Literacy Is NOT
It is important to be clear about what Article 4 does not require:
- It does not require everyone to become a data scientist. Literacy is proportionate to role and context.
- It does not mandate specific certifications. There is no "EU AI Literacy Certificate" required by law.
- It is not a one-time event. As AI systems evolve, literacy must be maintained and updated.
- It is not just an e-learning module. The obligation requires genuine understanding, not box-ticking.
The August 2, 2025 Deadline: What Happened and What Comes Next
Article 4 became applicable on August 2, 2025, in line with the AI Act's phased implementation timeline set out in Article 113. This was the same date that transparency obligations for limited-risk AI and the rules for general-purpose AI models (GPAI) took effect.
Current Enforcement Status (March 2026)
As of March 2026, formal enforcement actions specifically targeting Article 4 non-compliance have not yet been publicly reported. However, the enforcement landscape is developing rapidly:
- National competent authorities are being designated across EU member states. Under Article 70, each member state must designate at least one national competent authority for AI Act supervision.
- The EU AI Office within the European Commission (established under Article 64) has primary responsibility for GPAI rules and supports member states on implementation, including AI literacy guidance.

What This Means for Organisations
The fact that major fines have not yet been issued for Article 4 violations does not mean the obligation is dormant. Regulatory enforcement typically follows a pattern: guidance, then warnings, then action. Organisations that establish AI literacy programmes now are:
- Complying with an obligation that is already in force
- Building a demonstrable compliance track record that supervisory authorities will recognise
- Preparing the foundation for high-risk AI compliance (due August 2, 2026), which cannot be achieved without literate staff
- Reducing operational risk from AI misuse, bias incidents, and reputational damage
How Article 4 Interacts With Other AI Act Obligations
Article 4 is not an island. It is structurally connected to multiple other provisions of the AI Act.
Human Oversight (Article 14)
High-risk AI systems must be subject to effective human oversight. Article 14(4) requires that the natural persons tasked with human oversight must have the "necessary competence, training and authority" to fulfil their role. Without AI literacy, human oversight is a formality โ the person reviewing AI outputs cannot identify errors, bias, or malfunctions they do not understand.
Risk Management (Article 9)

Deployers of certain AI systems must inform users that they are interacting with AI, or that content is AI-generated. Staff responsible for transparency disclosures must understand what constitutes an AI system and when disclosure obligations are triggered โ this is AI literacy in action.
Incident Reporting (Article 62)
Deployers of high-risk AI must report serious incidents to national authorities. Recognising a "serious incident" โ a malfunction, bias event, or safety failure โ requires staff who understand what the AI is supposed to do and can identify when it is not doing it correctly.
Data Governance (Article 10)
For high-risk AI, training, validation, and testing data must meet quality criteria. This requires data teams with sufficient AI literacy to understand bias in datasets, representativeness, and the implications of data choices on system outputs.
The Cascading Effect
The relationship is clear: Article 4 is the enabler. Without AI-literate staff, Articles 9, 10, 14, 50, 52, and 62 become paper exercises. This is precisely why Article 4 was given an early application date โ the legislature intended organisations to build foundational competence before the heavier obligations take effect.

What is AI literacy under the EU AI Act?
AI literacy is defined in Recital 20 of Regulation (EU) 2024/1689 as "skills, knowledge and understanding that allow providers, deployers and affected persons, taking into account their respective rights and obligations in the context of this Regulation, to make an informed deployment of AI systems and to gain awareness about the opportunities and risks of AI and possible harm it can cause." It is a principles-based standard, not a specific certification or curriculum. The required level of literacy depends on the person's role, technical background, and the context in which AI systems are used. At minimum, it requires understanding what AI is, how it makes decisions, what its limitations are, and what risks it poses.
Is AI literacy mandatory under the EU AI Act?
Yes. Article 4 of the EU AI Act creates a binding legal obligation for all providers and deployers of AI systems to ensure sufficient AI literacy among their staff and other persons operating AI on their behalf. This is not a recommendation or best practice โ it is a legal requirement with potential penalties of up to EUR 7.5 million or 1.5% of global annual turnover for non-compliance (Art. 99(4)). What is the deadline for AI literacy compliance?
The Article 4 AI literacy obligation became applicable on August 2, 2025, as specified in Article 113 of Regulation (EU) 2024/1689. This was the same date that transparency obligations for limited-risk AI and GPAI model rules took effect. There is no additional grace period. Organisations that have not yet implemented an AI literacy programme are already non-compliant and should act immediately.
Who needs AI literacy training?
Article 4 covers "staff and other persons dealing with the operation and use of AI systems" on behalf of providers and deployers. This includes: employees who use AI tools in their daily work; developers and engineers building or maintaining AI systems; managers who make decisions based on AI outputs; procurement teams selecting AI tools; compliance and legal teams overseeing AI governance; C-suite executives with strategic AI oversight; and contractors, consultants, or outsourced personnel operating AI on the organisation's behalf. The level of literacy required varies by role, but the obligation to provide it applies to all.
What does an AI literacy programme need to include?
Based on Recital 20 and the AI Office's implementation guidance, a compliant AI literacy programme should cover: (1) what AI is and how it works at an appropriate level for the audience; (2) the capabilities and limitations of the specific AI systems deployed; (3) risks including bias, errors, hallucinations, and privacy implications; (4) human oversight responsibilities; (5) the EU AI Act's relevance to the person's role; and (6) what to do if an AI system produces unexpected, incorrect, or harmful outputs. The programme must be differentiated by role and regularly updated. Generic "introduction to AI" content that does not address the organisation's specific AI use cases is unlikely to satisfy the "sufficient" standard.
How should organisations document AI literacy compliance?
Organisations should maintain: a written AI literacy policy with governance ownership; a needs assessment documenting how training was tailored to roles and AI use cases; training records showing who was trained, when, and on what content; assessment results demonstrating comprehension; and an update log showing how the programme evolves. While the AI Act does not prescribe specific documentation formats, the "to their best extent" standard in Article 4 means supervisory authorities will evaluate the proportionality and genuineness of the measures taken โ and documentation is the primary evidence.
